Massachusetts AG Reaches $865K Settlement Over Worker Misclassification and Sick Time Violations

BOSTON — Massachusetts Attorney General Andrea Joy Campbell reached an $865,000 settlement with online grocery delivery companies Weee! Logistics LLC, Weee! OD Foods LLC, and their president Min Liu. This resolves claims related to worker misclassification and violations of earned sick time rights.

The Attorney General’s Office found that Weee!:

  • Misclassified delivery drivers as independent contractors, denying them minimum wage, overtime, and sick leave.
  • Failed to provide required pay stubs.
  • Violated the Massachusetts Earned Sick Time Law by not allowing drivers to accrue or use up to 40 hours of job-protected sick time annually.

 Under the settlement, Weee! will reclassify its drivers as employees, comply with all wage and hour laws, and issue restitution checks later in 2025 to more than 160 affected drivers from 2021–2024. 

This case highlights Massachusetts’ strict ABC test for determining worker status and the costly consequences of noncompliance. Employers are advised to review classification policies, audit sick leave compliance, and provide clear written policies to avoid similar penalties.
